Will I get paid time and a half today?

Hello, it is labor day and I have to work because my boss is supposedly on vacation in New Orleans (LIAR)…. I am non-exempt so will I get time and a half or holiday pay today? Is it illegal if he doesn’t pay me holiday pay? Also, can I refuse to work a holiday?
P.S I live in Austin, TX…. I don’t know if it would vary by city or state.
Um, I don’t work in a super market….. I work in a spa…

lol, vacation to new orleans, ok, um, seeing as this is a holiday, you are probably going to get paid in holiday pay. It would probably be illegal for your boss not to pay you in holiday pay.

Not only does it vary State to State, but in states that are hire and fire at will, overtime is not mandatory for holidays. Do you actually think that supermarkets and fast food businesses pay their help time and a half for working holidays? Nope!

Technically and legally you should get paid. But it really depends on what the employment terms say. For example, you could be offered compensatory time off, or they could add those hours to your vacation balance.

Also, working on holidays could be part of your employment requirements, as long as it doesn’t exceed 40 hours a week. Good examples are fire fighters, fast food staff, amusement park employees, etc.

When it comes to labor law, there are multiple ways to skin a cat.

You can definitely refuse to work on that day, but they can easily refuse to keep you employed as well. Remember, it goes both ways./
